Data Breach Litigation

The Firm has emerged as a leader in the rapidly developing field of data breach litigation, representing consumers and businesses whose confidential data has been stolen in some of the largest and most significant data breaches in history, including the recently disclosed breach at Equifax, Inc.

In 2017, Ariana Tadler was appointed by the Court as one of five members of the Plaintiffs’ Executive Committee in a class action arising from a breach affecting more than 3 billion user accounts at Yahoo!, Inc. The Firm is primarily responsible for leading the massive and complex discovery efforts in the Yahoo! case. The information stolen from Yahoo! includes the names, email addresses, telephone numbers, birth dates, passwords and security questions of Yahoo account holders, as well as the private information contained in users’ emails, such as financial communications and records involving credit cards, retail accounts, banking, account passwords, IRS documents, and social security numbers.

We also serve as co-counsel, and counsel responsible for spearheading discovery, in a class action against Wendy’s International, LLC, concerning a data breach that impacted customers of over 1,000 of the company’s fast food franchises. The Firm has also played a significant role in numerous data breach cases against insurance companies, including Anthem, Premera and Excellus. Ms. Tadler also served on the leadership team representing millions of consumers victimized by the 2013 data breach at Target Corp.

The Firm will continue working aggressively to vindicate the rights of consumers and businesses victimized by data breaches, and hold to account companies that fail to take adequate measures to safeguard their customers’ confidential data.
